The hospital staff informed the HRA that they were familiar with the recipient. According to the social worker, the recipient was known from previous hospital admissions. The social worker recalled during her hospitalization, the recipient had expressed concerns about her preference to take specific medications that were prescribed for her prior to this admission. The staff commented that the recipient requested her regular psychiatrist to be contacted because she insisted on remaining with the same medications. The staff explained that it is not unusual for patients who demonstrate a history of noncompliance with medications to resist them when initially hospitalized. The staff reported that nurses are required to inform the Attending Physician of these situation. According to the NM, prior to the administration of medications, patients are informed of risks and benefits, but patients may still refuse treatment. The NM further commented that when they refuse, nursing is responsible for encouraging patients to comply with all recommendations by the Physician in an effort to achieve the goals of treatment. The HRA noted that the record contained the recipient's medication consent form, which confirmed that the hospital had obtained written consent to administer the following medications: Elavil, Zoloft and Ativan. The consent form also documented that the patient refused to take Haldol and Tegretol. Included on the consent form were written statements that the recipient had severe adverse reactions from a past experience with these drugs. The NM responded that when a patient refuses medication, it is communicated to the psychiatrist, and it would ultimately be the Physician's decision to amend the order. The staff further discussed, pursuant to their medication policy, that medication is only administered over a patient's objection when she presents imminent danger to herself or others.
